1 - Purpose
This agreement sets forth the specific terms and conditions that will govern the purchase of products or services through the websitewww.swimhome.es without prejudice to the possibility that the parties may agree on different conditions by mutual agreement.
Acceptance of this contract electronically is as valid as signing this contract in person. When processing your purchase electronically, you will be asked to read and confirm this contract. By processing your order electronically, you unequivocally accept these terms and conditions of service.
A copy of this contract will be sent to you via the e-mail address provided at the time of registration.
The purchase and contracting process will be carried out in Spanish.
2 - Purchase process
The purchase procedure in
To make the purchase process is not essential a previous registration, but you will be asked for the personal data necessary to process the order, shipping and billing. These data will only be used to manage the service and will only be transferred to the companies responsible for delivering your order, manufacture or tax advisory service and according to our privacy policies.
To successfully process an order, you must follow the steps below:
2.1 - Add the product to the cart
Within the product page and, after selecting the quantity of units you need to buy, you must click on the "Add to cart" button, this will add your products to your shopping cart. You will also be shown this option on the category pages for certain products.
You will be shown a window where you have two options: "Buy" or "Continue shopping". If you need to add more products to your purchase select "Continue shopping", if you have already selected all the products you need click "Buy" to access your cart.
2.2 - Your Shopping Cart
Within the Cart page you will be shown a summary of your purchase, the products selected, the units of each product and the value of your purchase.
If you are satisfied, just click on the "Buy" button.
2.3 - Your access data
On the "Personal data" page you will be asked for your identification data, such as name, surname and your access data such as your e-mail address and a password (optional) in order to create an account. If you wish to create a new account, you must add a new password in the corresponding section. You can also create an account using your Google or Facebook profile by clicking on their respective buttons.
2.4 - Your addresses
In the section "Addresses" you will be asked for your personal data. In this section you must enter the precise shipping information
In case your billing address is not the same as the delivery address, you must select: "The billing address differs from the delivery address" to open a new form where you will enter your billing address. In the VAT number section you must enter your ID or VAT number.
Both addresses will be clearly identified to ensure delivery to the address you have requested.
Once you have entered the required data, click on the "Continue" button.
2.5 - Method of shipment
In the "Shipping method" section you will be presented with different shipping options. You can learn more details on the Shipping and Returns page
You may only be shown one shipping method depending on where the delivery address is. On very bulky or heavy products it is possible that a delivery option may not be shown for certain addresses. In these cases please contact us for a shipping quote.
In this section you will find a field to enter any information you consider necessary to facilitate the delivery of your package.
After selecting your preferred shipping method click on the "Continue" button.
2.6 - Secure payment
In the "Payment" section you must select the payment method of your preference.
We offer our clients the following payment methods:
Payment by credit card: If you wish to process your payment with your credit card, you must select this option. You will be asked for your credit card information. The process is completely secure through the Redsys gateway. If you wish, you can save your card for future purchases. In this case the data will be stored in encrypted form according to industry standards on Stripe's servers.
Aplazame - Payment in installments: If you wish to finance your purchase to pay for it in easy installments, select this payment method. You can get more information about it on this page.
Aplazame - Payment in 15 days: If you wish, you can process your purchase and pay for it 15 days after shipment. You will be asked for your bank card to charge the payment after this period. This payment method is limited to orders under 500 €.
Payment with Viabill: You can finance your purchase in 4 interest-free installments. You will be asked for your bank card to charge your order in monthly payments. You will also be asked for a copy of your ID card for your financing study. Viabill may deny financing if the transaction exceeds its risk standards.
Payment by bank transfer: If you select this method of payment you will be provided with the details to make the transfer once you have confirmed your order. You will also receive an email with these details. Please note that if you select this payment method we will not start preparing your order until we have received the money in our bank account. This process can take up to 3 days. The products in your order will be reserved for 3 days, once this period has elapsed you will need to place a new order
Payment by PayPal: When you select this payment option you will be asked to log in to your PayPal account. You will also be able to pay with your bank card without logging into the PayPal page
Once you have selected the payment method of your choice, you will need to agree by clicking on the box to the left of "I agree to the terms of service and terms of revocation and accept them without reservation"
Then review your order before making the payment in the summary box.
Finally click on the "Confirm Purchase" button to finalize and confirm your order.
The entire purchase, account creation and payment process is protected by SSL encryption both on the www.https://swimhome.es/es/ page and on the payment gateways available on the web. To confirm this, please make sure that the website where you are going to make the payment starts with https://
2.7 - Order confirmation
Once you have completed all the steps indicated in section 2.6 you will be shown the confirmation of your order together with a summary of your purchase.
You will then receive an email at the email address you provided with a summary of your purchase, terms of service and terms of revocation. This email usually arrives in less than 20 minutes, but may be delayed up to 24 hours at certain times.
This confirmation, together with your proof of payment, will be used for any queries or complaints you may have.
If you do not receive the confirmation email within 24 hours of your order confirmation, please check the "junk mail" or "spam" folder of your email service. If you do not find your email in this folder either, please contact us to solve the problem as soon as possible.
3 - Pricing, invoicing and payment
The customer agrees to make the payment of all orders placed through the website www.swimhome.es.
The prices shown on the website are always prices including VAT except in professional accounts. In any case it will be indicated at all times whether or not VAT is included in the price. Nor will the price with VAT be shown to those users who, due to their place of residence, are exempt from paying VAT and provided that they have registered this information in their account and have logged in to their account
In any case the price and taxes will be broken down in the shopping cart and in the invoice provided once the order is confirmed
The prices shown on the website are binding except in case of computer error.
The prices shown do not include installation, unless expressly indicated
4 - Shipment of your purchase
Please note that shipping methods are outside the scope of this document
4.1 - Shipment of your purchase
The shipment of your order will be made by the method selected by the customer at the time of confirmation of your purchase once payment has been confirmed
Orders will be processed and shipped within 24/72 hours of receipt of order confirmation. We try to handle all orders received before 13:00 on the same day whenever possible. This excludes custom made products, which require additional production lead time. This lead time may vary depending on various factors.
Once your order has been shipped, we will inform you by e-mail.
4.2 - Delivery time
The delivery time of the products is shown in the product description. Please note that the delivery times shown in the product description counts the preparation time and the estimated shipping time in the fastest shipping method available.
The time frame shown in "Shipping Method" (section 2.5) are the time frames of the contracted parcel service and do not take into account the preparation of the orders.
The lead times shown, both on the product page (preparation + shipping) and on the "Shipping method" page (shipping only), are in working days. These deadlines are approximate and may be delayed up to 10 days in specific cases and up to 60 days for custom-made products. For custom-made products, the production period will begin when the customer provides the manufacturing data. In case the data provided are not correct and we need to contact the customer to confirm any measure, this period will not begin until the customer makes such confirmation.
In the event that due to high demand the stock of any product is exhausted and this could not be updated on the web before placing the order, shipments will be processed in order of receipt. Subsequently the customer will be informed via email or phone call of the situation and the expected delivery times. In these cases the customer will be offered the possibility of requesting a full refund for the value of their purchase and shipping costs if any.
In order to process your order, it is essential that you have provided correct and accurate information. In the event that any of the information provided is incorrect, we will not be able to process your order
4.3 - Shipping costs
Shipping costs on orders over 50€, within the Iberian Peninsula, are included in your purchase. The service included in the price is a standard service
Optionally we make available to our customers Premium delivery services, faster or with delivery at the post office. The price of this service will be calculated according to the weight and volume of your purchase and the delivery address
For delivery addresses other than the Iberian Peninsula, shipping costs will be calculated during the checkout process based on weight, volume of your purchase and delivery address. If no delivery option is shown in "Shipping methods" please contact us for a custom quote. It is likely that the companies we usually work with will not deliver to your location or will not be able to carry a certain weight or volume. We will prepare a quotation with a suitable company.
Shipping costs to non-EU destinations do not include customs charges. Likewise, IGIC and clearance costs for shipments to the Canary Islands are excluded. These costs, as well as the costs incurred for refusing the package without a valid reason according to this contract shall be borne by the customer
4.4 - Receipt of goods
In order to facilitate delivery, we provide the parcel carrier with your address and contact telephone number, however, we cannot guarantee that the carrier will call prior to delivery.
Orders placed in
We recommend the customer to previously check the package before confirming the delivery note and reflect any damage in case there is any
Once received and confirmed the good condition of the package, the customer must check the condition of the goods and notify us in case of any damage within 48 hours. We cannot be held responsible for any physical damage (breakage, bumps...) after this period.
5 - Warranty

The customer undertakes to notify within a period of less than 2 months of any damage to the product.
6 - Order cancellation
The customer may request the cancellation of his order whenever his order has not begun to be processed, or when the deadlines set forth in section 4.2 of this contract have been exceeded.
7 - Right of withdrawal
The customer has 14 calendar days, counting from the day the order was delivered, to exercise his right of withdrawal.
To return the product, it must be in its original condition, in its original packaging and with all its accessories. Shipping costs on returns are borne by the customer, unless there is a defect in the product. We will never accept returns of custom-made products, in case there is any defect in it, we will proceed to process the warranty of the product.
To successfully process a return you must follow the steps below
- Access the section "Order history"of your account.
- Select the order for which you want to return an item by clicking on "Details".
- Select the product(s) you wish to return by checking the checkbox next to its name(s).
- Add the quantity you need to return (in case more than one product needs to be returned).
- (optional) Add an explanation, so that the store team can better understand why the customer wants to return this product, this is important in case you consider that there is a defect in the product or shipment.
- Click on "Request a return".
To exercise your right of withdrawal you can also inform us within the period described above by ordinary mail, e-mail or telephone. You will be given the shipping address where you must send the products on which you wish to exercise your right of withdrawal
Once the package has been received and analyzed, the refund will be processed. This process can take up to 14 calendar days.
7.1 - Conditions of shipment
In case of exercising your right of withdrawal, you will be responsible for managing the return of the products to the address indicated after making the request. This address may vary depending on the type of product, but it will always be a peninsular shipment
You are free to select the shipping company of your convenience, but to ensure proper delivery, we recommend that you use one of those we use to manage our shipments (Correos, CorreosExpress or Zeleris). The reason for this recommendation is that these companies pass daily within the opening hours
The package will be delivered from Monday to Friday before 14:00 hours, as this is the closing time. If the carrier passes at a later time than the indicated time, he will find the premises closed and will not be able to make the delivery
7.2 - Product status
The product(s) must be returned in the same condition in which they were sent, in their original packaging and together with all their accessories
No returns will be accepted under the following conditions
Scratched, stained or bruised product.
Product with its cable cut or with clear signs of having been tampered with.
Products with their box stained, painted or with labels directly stuck on the product box.
Please note that in order to exercise your right of withdrawal, the product must be in perfect condition. We recommend that you adequately protect the product and its original box to prevent wear and tear on the box during shipping, thus avoiding labeling the original box
7.3 - Tailor-made products
In accordance with the provisions of Article 45 of Royal Decree Law 1/2007, it will not be possible to exercise your right of withdrawal on products that have been custom-made or clearly personalized, or which, by their nature cannot be returned or may deteriorate or expire rapidly
In the event of a defect in one of these orders, we will proceed to manage the warranty of the same.
In some cases, custom-made products may present variations of a few centimeters. This is normal and may be due to different factors unrelated to the quality of production. In no case will a measurement error of +/- 5 cm be processed under warranty.
Bubble blankets may shrink in size due to the sun during the first year. This is a normal reaction to the sun for thermal blankets and no warranty applies
7.4 - Other exclusions to the right of withdrawal
The right of withdrawal may not be exercised in the following cases:
Customized or clearly personalized products
The provision of services once they have been performed or have begun to be performed.
Products that may expire or deteriorate.
Products unsuitable for health or hygiene reasons once they have been unsealed.
7.5 - Refund of money
Once the goods have been received, and after verifying that the conditions for withdrawal have been met, we will process the refund of the value of the returned products by the same means that the payment was made. Shipping costs that have clearly been charged at the time of the order are excluded from this refund.
8 - Stock and availability of products
The stock status of each product and delivery time will be indicated on each product page. In the event that due to a peak of demand the stock of the products is exhausted before we can update the status, we will contact the customer to indicate this fact. In these cases, we will offer the following options:
Wait for stock replenishment. In these cases we will inform you of the estimated restocking time.
Replacement of the product with one of the same or higher quality
Request the cancellation of your order. In this case a full refund of the value of your purchase and shipping costs will be made.
9 - Responsibility
We are not responsible for damage or injury to ourselves or third parties that may be caused due to a defective or improperly installed product as well as unforeseen delays in the delivery of the order.
We are not responsible for the execution of the contract and the non-fulfillment of the dates marked in case of force majeure, such as strikes, fires, floods, among others
10 - Product images
On some product pages the customer is offered the possibility to add, or modify some product feature. In these cases the product images will be modified in order to show these changes.
Please note that the colors of the products may vary slightly depending on the photograph or the user's screen, so the color received may be slightly different.

12 - Safeguard clause
All clauses or terms of this contract must be interpreted independently and autonomously. The remaining clauses shall not be affected in the event that one of them has been declared null and void by a final court decision. The contracting parties agree to replace the affected clause or clauses with one or more others that preserve the effects intended by the parties.
